Beyond Your Estate Planning Documents
Your Estate Planning documents may not control the disposition of all of your assets after your death (or even during your lifetime). Ownership of some of your assets may be controlled by state property laws or the law of contracts. These laws will control disposition of your property regardless of what your estate planning documents say. Therefore, you need to carefully review how you own certain properties; whom you have designated as beneficiaries for life insurance, annuities, and retirement accounts and benefits; and how account opening/signature cards for financial and investment accounts read.
